Declaration of Protective Covenants for the Rose Meadow Subdivision in McKenzie County, North Dakota

TO ALL WHOM THESE PRESENTS SHALL CONCERN:

Broderson, LLC, a North Dakota limited liability company [hereinafter “Developer”], sendeth greetings:

WHEREAS the Developer is the owner of certain real property situated in the County of McKenzie, State of North Dakota, and intends and agrees to establish a general plan of development with respect to the same; and

WHEREAS a plat entitled Rose Meadow Subdivision [hereinafter the “Plat”] has been filed in the office of the Recorder in and for McKenzie County, North Dakota; and

WHEREAS said Plat describes the subdivision of certain real property within McKenzie County, North Dakota [hereinafter the “Development”]; and

WHEREAS for the purpose of maintaining fair and adequate property values on said property and to develop or cause the development and to maintain or cause the maintenance of said premises according to the plans and practices assuring maximum common benefits and amenities to future residents and future owners of any of the lots within the Development,

NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that in mutual consideration as the owners and developers of the said subdivision, the Developer, for itself and its successors and assigns, agrees with all persons, firms, or corporations acquiring any of the property within the Development that the same shall be and is hereby subject to the following restrictions, conditions, and covenants [hereinafter “Restrictions”] relating to the use and occupancy thereof, which said restrictive covenants are to be construed as covenants running with the title to the lots within the Development, as shown on the Plat hereinbefore referred to, and shall inure to the benefit of and be binding upon the heirs, successors, and assigns of the acquiring parties or persons, said property is described more fully, as:

Rose Meadow Subdivision, McKenzie County, North Dakota
Block 1: Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10
Block 2: Lot 1

Said lots all lying within land situated in McKenzie County, North Dakota, and described as follows:

Township 150 North, Range 99 West of the 5th P.M.
