Permitted Structures. The following structures are permissible on each lot:
a. Primary structure. The primary structure on each lot must be a single-family dwelling. The primary structure must have a poured concrete foundation or poured concrete basement and must not consist of less than one complete story at or above grade nor more than two and one-half stories at or above grade. The principal roof of the primary structure must not have a pitch less than 4/12 nor more than 12/12 except that compound-pitch rooflines may be approved by the Developer. Other roof lines, including those over dormers, porte-cocheres, and the like, may have a different roof pitch than the principal roof. The primary structure must contain no less than 1,500 square feet of heated, occupied space on its main occupied level, which need not be at ground level. The primary structure must contain only natural earth-tone colors or white on all exterior surfaces except by Developer’s written approval. Prior to the commencement of construction of the primary structure, architectural plans must be submitted to the Developer and the Developer’s written approval given to those plans. For structures not constructed on-site, the commencement of construction shall be defined as the placing of an order to construct the structure off-site. Construction of the primary structure must match all external details of the architectural plans that were approved by the Developer. The primary structure must be constructed and occupied within a reasonable time and without unreasonable delays or stoppages after the commencement of construction.
b. Secondary structure. Each lot may contain no more than two secondary structures, each of which shall be a barn, workshop, garage, or structure designed for a combination of those uses and must comply with these Restrictions. Commencement of construction of a secondary structure may not occur until the primary structure has been constructed and occupied. Each secondary structure must be permanently affixed, either by poured cement footings or a poured cement slab floor. Each secondary structure must be constructed with a roof pitch of no less than 4/12 nor more than 12/12 except that compound-pitch rooflines may be approved by the Developer. All secondary structures must be constructed with the same roof pitch as each other unless approved by the Developer. Other roof lines, including those over dormers, porte-cocheres, and the like, may have a different roof pitch than the principal roof. Each secondary structure must bear the same primary sidewall and roof colors of the primary structure unless the Developer gives written approval of different colors. Each secondary structure must be architecturally designed or engineered. Prior to commencement of construction of a secondary structure, the architectural plans or engineering plans for it must be submitted to the Developer and the Developer’s written approval given to those plans. For structures not constructed on-site, the commencement of construction shall be defined as the placing of an order to construct the structure off-site. Each secondary structure must have sidewalls no more than 16 feet high and must have an overall footprint no less than 50% nor more than 100% of the footprint of the primary structure on the lot, with a ratio of width to length between 3:4 and 4:3. A secondary structure must be constructed and occupied within a reasonable time and without unreasonable delays or stoppages after the commencement of construction. A primary structure may be re-designated as a secondary structure and a replacement primary structure constructed, provided that the Developer must approve all architectural plans and the replacement primary structure must be constructed and occupied within a reasonable time and without unreasonable delays or stoppages after re-designation.
c. Accessory structure. Each lot may contain no more than one accessory structure. The accessory structure may not be placed on the lot or constructed until the primary structure has been constructed and occupied. The accessory structure must bear the same primary sidewall and roof colors as the primary structure unless the Developer gives written approval of different colors. The accessory structure may not have an overall footprint of more than 160 square feet. The sidewalls of the accessory structure must not exceed 6 feet above grade. The roof of the accessory structure must have the same pitch as either the primary roofline of the primary structure or the secondary structures on the lot. The accessory structure must be constructed within two months of the commencement of construction. The accessory structure must be affixed to the ground with appropriate anchors or a poured concrete slab floor.
d. Mobile home. A mobile home may be placed on the lot temporarily during construction of the primary structure. The mobile home must be occupied pursuant to the occupancy requirements of these Restrictions during construction of the primary structure. The mobile home must be removed from the lot immediately after construction of the primary structure is completed to a point at which it can be occupied. The mobile home may not be placed on the lot more than three months prior to commencement of construction of the primary structure. For the purposes of this paragraph, a mobile home includes a recreational vehicle. The mobile home may be connected to the same electrical, water, and septic or sewer connections to which the primary structure will be connected.
e. Fences. A fence may be constructed on the lot, including on the boundary between the lot and an adjacent lot upon written approval of the owner of such adjacent lot and written approval by the Developer, such approval to be binding on future owners of such adjacent lot. All fences must be of a type specified by the Developer. The total length of all fences on the lot, including on lot boundaries (which shall count toward the total length of fences on both lots sharing the boundary), must not exceed 550 linear feet per surveyed acre of the lot as stated on the Plat. No area enclosed by any fence or combination of fences on the lot may exceed 100,000 square feet. No area enclosed by any fence or combination of fences on the lot may be less than 10,000 square feet, except for fences which are attached to the primary structure in such a way that a door into the primary structure opens into the area enclosed by the combination of the fence and the exterior wall of the primary structure (a privacy fence), which may not enclose an area greater than 2,000 square feet nor less than 400 square feet. The Developer may give written approval to requested variances from the limitations of this paragraph.
f. Flag pole. One flag pole may be erected on the lot. Flag poles must be no less than 10 feet nor more than 30 feet in height, must be of a style approved by the Developer, and must fly the official flag of the United States of America at the topmost position. If a flag pole is present on a lot, then flags must be flown on all days the lot is occupied. Flags must be lowered and removed from the pole at night unless proper lighting is provided, and all flag pole lighting must be approved by the Developer. Flags must be flown at half-mast when directed by the President of the United States of America or the Governor of the State of North Dakota.
g. Address sign. A single sign may be placed at the entrance to the lot from the roadway, which must display the address number of the lot and may display the name of the owner of the lot or the name of the lot given to it by the owner. All such signs must be of a design approved by the Developer and shall be placed in a location approved by the Developer.
h. Crossing lot boundaries prohibited. Notwithstanding the combination of adjacent lots, no structure, including a fence other than one on a lot boundary, may be placed or constructed across a lot boundary as indicated on the Plat.
